These Website Terms of Use govern your use of sarafandtech.com (the “Website”), operated by Sarafand Tech LLC, a New Mexico limited liability company (“Sarafand,” “we,” “us” or “our”). By using the Website, you agree to them. If you don’t agree, please don’t use the Website.

1. Our apps have their own terms

Each of our apps is governed by its own Terms of Service and Privacy Policy, listed above. For anything to do with an app, including purchases and subscriptions, the app’s terms apply, and they control if they differ from these. Downloads and purchases through the App Store or Google Play are also subject to Apple’s or Google’s terms.

2. Using the Website

You may browse the Website, read it and share links to it. You agree not to:

• use the Website in any way that breaks the law or infringes anyone’s rights;
• try to gain unauthorized access to it, interfere with or overload it, or probe it for vulnerabilities;
• copy or scrape it in bulk by automated means, other than by search engines indexing it;
• send spam, malware, false information or anything unlawful through its forms; or
• impersonate anyone or misrepresent your connection with anyone.

3. Our content and trademarks

The Website’s text, graphics, logos, app names, icons and illustrations belong to Sarafand or its licensors and are protected by intellectual property laws. You may not copy, modify or republish them without our written permission, except for brief quotation with attribution or as the law otherwise allows. App Store and iPhone are trademarks of Apple Inc. Google Play and Android are trademarks of Google LLC. Other names belong to their owners. EPA 608 Mastery Pro is not affiliated with the U.S. Environmental Protection Agency.

4. Information on the Website

We work to keep the Website accurate and current, but descriptions, features, availability and prices may change and may contain errors. Prices are shown in US dollars; the price the App Store or Google Play shows you before you buy is the one that applies. Illustrations of our apps are representative and may differ from the app on your device. Nothing on the Website is legal, regulatory, safety, driving or other professional advice.

5. Messages and feedback

When you use our contact or launch-update forms, please give accurate information. Our website privacy notice explains how we handle it. Please don’t send us confidential or sensitive information. If you send ideas or feedback, we may use them freely and without any obligation to you.

6. Links to other sites

The Website links to sites we don’t control, such as the App Store, Google Play and our service providers. We aren’t responsible for their content, policies or practices.

7. Disclaimer of warranties

THE WEBSITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SARAFAND AND ITS MEMBERS, MANAGERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED FIFTY U.S. DOLLARS (US$50). Some jurisdictions don’t allow certain limitations, so some of these may not apply to you; where that’s the case, our liability is limited to the fullest extent the law permits. The members and managers of Sarafand Tech LLC have no personal liability to you in connection with the Website.

9. Governing law

These terms and any dispute arising out of or relating to the Website are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. Any such dispute must be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you and Sarafand consent to their jurisdiction. Disputes about an app are governed by that app’s Terms of Service.

10. Changes to these terms

We may update these terms by publishing a new version here with a new date. Using the Website after an update means the updated terms apply to you.
