    Terms of Service

    Effective date and last updated: October 15, 2026

    PLEASE READ THESE TERMS CAREFULLY. They limit our liability, require you to indemnify us, and contain a binding individual arbitration agreement with a class-action and jury-trial waiver (see "Dispute resolution and binding arbitration"). Those provisions affect how disputes are resolved. You may opt out of arbitration within 30 days, as described there.

    These Terms of Service (the "Terms") are a legally binding agreement between you and Sarafand Tech LLC, a New Mexico limited liability company ("Sarafand," "we," "us," or "our"). They govern your download, access to and use of the LimitBeep mobile application for iOS and Android, including its speed-limit information, alerts, features, updates and subscriptions (together, the "App").

    By downloading, installing, accessing or using the App, or by starting a trial or subscription, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

    In short

    • LimitBeep is a driving aid. Posted signs always take priority over the App, and you are responsible for your speed.
    • Speed-limit data can be wrong or out of date, and alerts can be late or missed.
    • The map and speed-limit data is licensed from HERE. It is for your own use with the App only, and HERE's conditions in "Map data" apply to it.
    • After a 7-day free trial (one per Apple ID or Google account), the subscription renews automatically until you cancel it in your Apple or Google account.
    • Our liability is limited, and disputes are settled by individual arbitration — not class actions or jury trials. You can opt out of arbitration within 30 days.

    1. Eligibility

    You must be at least 16 years old, or hold a learner's permit, to use the App. If you are under 18, or under the age of legal majority where you live, you may use the App only with the consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use. The App is not directed to children under 16. You represent that you are not barred from using the App under the laws of the United States or any other applicable jurisdiction.

    2. A driving aid only

    What the App is. LimitBeep is a supplemental driving aid that shows estimated speed-limit information and gives audible alerts based on GPS location and third-party map data. It is a convenience tool only and does not replace your obligation to observe and obey all posted signs, signals and traffic laws.

    Not official. The App is not affiliated with, endorsed by or connected to any government, police force or traffic authority.

    No guarantee of outcome. We do not guarantee that using the App will prevent speeding tickets, citations, fines, license points or suspensions, accidents, injuries or any other outcome. Nothing in our marketing promises that you will avoid tickets or any other outcome.

    No legal advice. Nothing in the App is legal advice about speed limits or traffic law. For questions about a citation or the law, consult a qualified professional.

    3. Speed-limit data and alerts

    THE SPEED LIMIT DATA AND ALERTS PROVIDED BY THE APP MAY BE INACCURATE, INCOMPLETE, OUTDATED, OR INCORRECT. THE APP RELIES ON THIRD-PARTY DATA SOURCES (INCLUDING HERE TECHNOLOGIES) AND GPS SIGNALS, WHICH ARE NOT INFALLIBLE. UNDER NO CIRCUMSTANCES SHOULD YOU RELY ON THE APP AS YOUR PRIMARY SOURCE FOR DETERMINING THE POSTED SPEED LIMIT OR SAFE DRIVING SPEED. YOU MUST ALWAYS REFER TO OFFICIAL ROADSIDE SIGNS AND MARKINGS AS THE AUTHORITATIVE SOURCE OF SPEED LIMIT INFORMATION. WE MAKE NO WARRANTY THAT THE APP WILL ALWAYS DISPLAY THE CORRECT SPEED LIMIT FOR ANY GIVEN ROAD OR LOCATION.

    The App does not know about temporary or variable limits, school zones in effect, construction zones, weather, road conditions or emergencies, and a safe speed may be well below the posted limit.

    Passenger cars. The limits shown are those for passenger cars. Trucks, vehicles towing a trailer and some buses may have lower limits, which the App does not show.

    4. Driving safety

    Set the App up before you drive. Don't touch, set up or adjust it while your vehicle is moving; while you drive, the App greys out its settings. Look at it only briefly and only when it is safe, as you would at your speedometer, and rely on the beep. Mount your phone securely and only where the law allows, and follow all hands-free and distracted-driving laws. The App is not a safety system, a collision warning system, or a radar, laser or police detector, and it must not be used as one.

    Young drivers. In many states, drivers under 18 or with a learner's or provisional license may not use a phone at all while driving, even hands-free. If that applies to you, set the App up before the drive and keep the phone out of sight; the beep needs no touching.

    Commercial vehicles. The App is not for use while driving a commercial motor vehicle. Federal rules restrict hand-held phone use by drivers of those vehicles.

    Alerts can be late, missed or wrong — for example when GPS is weak, the connection drops, the phone is in a battery-saving mode, the phone's system stops the App, permissions are changed, or the sound is muted or routed elsewhere. The absence of an alert never means you are within the limit.

    5. Your responsibilities

    You agree to: (a) observe all traffic laws and posted speed limits at all times; (b) maintain full control of your vehicle; (c) not touch, set up or adjust the App while your vehicle is moving, and look at it only briefly and only when it is safe; (d) use the App only where and when it is safe and legal to do so; and (e) keep your phone, its operating system and the App updated and correctly configured.

    6. Service availability and fair use

    The App needs an internet connection; without one, speed limits and alerts pause until the connection returns. We do not guarantee the service will be available at all times, in every place, or for every road.

    To keep the service affordable, each account has a monthly allowance of new speed-limit lookups that is well above what everyday driving uses. If an account goes past it, the App keeps showing speed limits for roads already in our shared cache, and may show no limit on other roads, until the allowance resets at the start of the next month.

    7. Subscriptions, trials and billing

    Free trial. The App requires a subscription after a 7-day free trial. The trial is available once per Apple ID or Google account, across both plans. Any unused part of a free trial ends when you buy a subscription. When the trial ends, the subscription starts and you are charged unless you cancel before the trial ends.

    Promotional offers. We may offer codes or other promotions that give a free or discounted period, including to people who have already had a free trial. The length of the offer, the plan it applies to and the price that follows are shown before you redeem it. When the promotional period ends, the subscription renews at the regular price unless you cancel in time, as described under "Auto-renewal and payment." Codes are for personal use and have no cash value.

    Auto-renewal and payment. Subscriptions are billed through the Apple App Store or Google Play, whichever you downloaded the App from, and charged to your store account when you confirm, including any applicable taxes. They renew automatically for the same period until you cancel. To stop the next renewal:

    • Apple App Store: cancel at least 24 hours before the end of the current period, in Apple ID → Subscriptions.
    • Google Play: cancel any time before the next renewal, in Google Play → Payments & subscriptions.
    • Free trial: cancel before the trial ends to avoid being charged.

    Deleting the App, or deleting your data in it, does not cancel a subscription. Where Apple Family Sharing is enabled, a subscription may be shared with family members. We do not receive or store your payment information.

    Renewal reminders. The App may show a reminder on your phone before an annual subscription renews, and once a year for a monthly one. A reminder is a courtesy: one that does not appear, for example because notifications are off, does not stop or delay a renewal.

    Prices. Prices are shown in the store before you buy and are set for your country. We may change prices, including by offering or ending introductory pricing. Any change to the price of an existing subscription follows the store's rules for notice and consent. A price change does not entitle anyone to a refund or credit for an earlier period.

    Refunds. Except where required by law, payments are final and non-refundable, and canceling stops the next renewal but does not refund the current period. Refunds for App Store purchases are handled only by Apple under its refund policy. Refunds for Google Play purchases are handled by Google under its refund policy, and we may also issue them at our discretion.

    Restoring and transfers. You can restore a subscription on devices signed in to the same store account with "Restore purchase." Subscriptions generally cannot be transferred between Apple and Google, or between store accounts, and have no cash value.

    Features. We decide which features require a subscription and may change them at any time.

    8. Your data

    Some information, such as your settings and trial summary, is kept only on your phone, as described in our Privacy Policy. We are not responsible for the loss or corruption of that information for any reason, including device loss or failure, deleting the App, operating-system changes or App updates.

    You can delete your data from the App's Privacy Policy screen. An anonymous account with no active subscription that has not been used for 18 months is deleted automatically, as described in our Privacy Policy.

    9. License

    Subject to your compliance with these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable license to download, install and use the App on devices you own or control, for your own personal, non-commercial use, subject to the usage rules of the store you obtained it from. The App is licensed, not sold. All rights not expressly granted to you are reserved by Sarafand and its licensors.

    10. Restrictions

    You agree not to, and not to allow anyone else to:

    • copy, scrape, extract, record, compile or redistribute speed-limit data or other content from the App or our servers, or use it to build, train or improve any map, dataset, competing product, or artificial-intelligence or machine-learning model;
    • access our servers other than through the App, or use automated means to send requests;
    • use the App for commercial, fleet or business purposes, or resell access to it, without our prior written permission. "Business purposes" means driving for hire or as a duty of your job, such as delivery, rideshare, trucking or fleet driving;
    • decompile, disassemble or reverse engineer the App, except to the extent this restriction is prohibited by law;
    • circumvent, disable or interfere with the subscription, trial, fair-use limits, or any security or access control;
    • modify, adapt or create derivative works of the App, or remove any proprietary notice;
    • use the App in any unlawful, fraudulent or harmful way, or in violation of these Terms or the applicable store's terms.

    11. Feedback

    If you send us reports, suggestions, ideas or other feedback, you grant Sarafand a perpetual, irrevocable, worldwide, royalty-free, fully paid, sublicensable and transferable license to use, copy, modify, publish and otherwise exploit it for any purpose. We have no obligation to review, use, keep confidential, credit or compensate you for it.

    12. Intellectual property

    The App and its software, design, text, graphics and logos are owned by Sarafand or its licensors and are protected by copyright, trademark, trade secret and other intellectual-property laws. Map and speed-limit data is licensed from HERE Technologies and its licensors and remains their property. "LimitBeep," "Sarafand" and related names and logos are trademarks of Sarafand and may not be used without our prior written permission. HERE and the HERE logo are trademarks of HERE Global B.V., which owns them; naming HERE does not mean HERE sponsors or endorses the App. Other trademarks belong to their owners.

    13. Third-party services

    The App relies on third-party services, including HERE Technologies (map data), Supabase (hosting and sign-in), RevenueCat (subscription management), Apple and Google. Your use of them is governed by their own terms and policies. We do not control them and are not responsible for their availability, accuracy, content, security or practices, or for any loss or damage they cause.

    14. Map data

    The speed limits and other road information in the App (the "Map Data") are licensed to us by HERE Global B.V., its affiliates and their data suppliers (together, "HERE"). This section protects HERE as well as Sarafand, and HERE may enforce it against you.

    When you use the Map Data, you agree:

    • to use it only for your own use with the App, and not with any other app, product or service;
    • not to use it with geographic data from HERE's competitors;
    • not to reverse engineer, archive or keep copies of it;
    • not to export it, or anything made from it, except in compliance with all applicable export laws, rules and regulations; and
    • to stop using it if you do not comply with these Terms.

    Supplier notices. The Map Data is subject to regulatory and third-party supplier restrictions and obligations, including copyright notices, which HERE publishes at https://legal.here.com/terms/general-content-supplier/terms-and-notices/ and which apply to your use of it. HERE's End User Terms (https://legal.here.com/terms/here-end-user-terms) and Privacy Policy (https://legal.here.com/privacy) also apply to HERE's data and services used through the App.

    U.S. Government end users. If you are a United States Government end user, or anyone else who wishes to claim similar rights, the Map Data is a "commercial item," as that term is defined at 48 C.F.R. 2.101, and is licensed to you under these Terms.

    No warranty. THE MAP DATA IS PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SARAFAND, HERE AND THEIR AFFILIATES AND SUPPLIERS DISCLAIM ALL WARRANTIES ABOUT IT, EXPRESS, IMPLIED OR OTHERWISE, INCLUDING WARRANTIES OF QUALITY, PERFORMANCE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

    No liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER SARAFAND NOR HERE, NOR THEIR AFFILIATES OR SUPPLIERS, WILL BE LIABLE TO YOU FOR ANY CLAIM, DEMAND OR ACTION, WHATEVER ITS CAUSE, ARISING OUT OF THE USE OR POSSESSION OF THE MAP DATA; OR FOR ANY LOSS OF PROFIT, REVENUE, CONTRACTS OR SAVINGS, OR ANY OTHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF, OR INABILITY TO USE, THE MAP DATA, ANY DEFECT OR INACCURACY IN IT, OR THE BREACH OF THESE TERMS, WHETHER IN CONTRACT OR TORT OR BASED ON A WARRANTY, EVEN IF SARAFAND, HERE OR THEIR AFFILIATES OR SUPPLIERS WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

    Nothing on HERE's behalf. We make no warranty or promise on behalf of HERE, its affiliates or their data suppliers, and nothing in these Terms gives you any right to liability or indemnity from them.

    Safety. The warnings and instructions in "A driving aid only," "Speed-limit data and alerts" and "Driving safety" apply to the Map Data too.

    15. Disclaimer of warranties

    In these Terms, the "Sarafand Parties" means Sarafand and its members, managers, officers, employees, contractors, agents, licensors and service providers.

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ALL DATA, ALERTS, FEATURES AND SUBSCRIPTIONS ARE PROVIDED "AS IS," "AS AVAILABLE" AND "WITH ALL FAULTS," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE. THE SARAFAND PARTIES EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND ACCURACY OR COMPLETENESS OF DATA, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. THE SARAFAND PARTIES DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, THAT ANY SPEED LIMIT OR ALERT WILL BE CORRECT OR DELIVERED, OR THAT DEFECTS WILL BE CORRECTED. NO ADVICE OR INFORMATION, ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE APP CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

    Some jurisdictions do not allow the exclusion of certain warranties. There, the exclusions above apply to the fullest extent permitted, and any warranty that cannot be excluded is limited to the shortest period the law allows.

    16. Limitation of liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE SARAFAND PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, WAGES, DATA OR GOODWILL; SPEEDING TICKETS, CITATIONS, FINES, PENALTIES OR COURT COSTS; INSURANCE PREMIUM INCREASES; LICENSE POINTS, SUSPENSIONS OR REVOCATIONS; VEHICLE OR PROPERTY DAMAGE; PERSONAL INJURY OR DEATH; OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THE APP, ANY DATA OR ALERT, ANY SUBSCRIPTION, THESE TERMS, OR YOUR DRIVING OR RELIANCE ON THE APP.

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF THE SARAFAND PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU ACTUALLY PAID FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR (B) FIFTY U.S. DOLLARS (US$50).

    These limitations apply to any theory of liability — contract, tort (including negligence), strict liability, product liability, statute or otherwise — even if the Sarafand Parties were advised of the possibility of such damages, and even if a limited remedy fails of its essential purpose. They are an essential basis of the bargain between you and Sarafand, and the App would not be offered without them. The members and managers of Sarafand Tech LLC have no personal liability to you under these Terms or in connection with the App.

    Some jurisdictions do not allow the exclusion or limitation of certain damages, such as for death or personal injury caused by negligence, or for fraud, gross negligence or willful misconduct. There, our liability is limited to the fullest extent the law permits.

    17. Assumption of risk and release

    You understand and voluntarily assume all risks of using the App and of your driving, including risks from inaccurate or missing data, GPS errors, missed or late alerts, software bugs, network outages and hardware failures. To the maximum extent permitted by law, you release and forever discharge the Sarafand Parties from all claims, demands, damages and liabilities of every kind, known or unknown, arising out of or relating to your driving, any citation, fine or penalty you receive, or your reliance on information shown, or alerts given or not given, by the App.

    If you are a California resident, you waive California Civil Code section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You also waive any similar law of any other jurisdiction.

    18. Indemnification

    To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless the Sarafand Parties from and against all claims, actions, demands, losses, damages, liabilities, judgments, settlements, fines, penalties, costs and expenses, including reasonable attorneys' fees, arising out of or relating to:

    • your access to, use or misuse of the App;
    • your driving, and any accident, citation or claim connected with it;
    • your violation of these Terms;
    • your violation of any law or the rights of any third party.

    We may assume the exclusive defense and control of any matter you must indemnify, at your expense, and you agree to cooperate with our defense. You may not settle any such matter without our prior written consent.

    19. Changes, suspension and termination

    We may modify, suspend or discontinue the App, or any feature, at any time, with or without notice, and without liability to you. We may suspend or terminate your access if you violate these Terms, in which case you are not entitled to a refund. You may stop using the App at any time by canceling your subscription and deleting the App. Provisions that by their nature should survive termination — including those on data and alerts, disclaimers, limitation of liability, release, indemnification, governing law and dispute resolution — survive it.

    20. Governing law

    These Terms, and any dispute arising out of or relating to them or the App, are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. The Federal Arbitration Act governs the arbitration agreement below. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any claim not subject to arbitration must be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you and Sarafand consent to the personal jurisdiction of, and venue in, those courts.

    21. Dispute resolution and binding arbitration

    Please read this section carefully. It requires you and Sarafand to resolve disputes through individual arbitration instead of in court, and it waives class actions and jury trials.

    Informal resolution first. Before starting any proceeding, you and Sarafand agree to try to resolve any dispute informally. The party raising it must send a written notice to the other — for notices to us, by email to info@sarafandtech.com or by post to the address in the Contact section — with the sender's contact information, a description of the dispute and the relief sought. If it is not resolved within sixty (60) days after the notice is received, either party may begin arbitration.

    Agreement to arbitrate. Except as provided below, any dispute, claim or controversy between you and Sarafand arising out of or relating to these Terms, the App, any subscription or our relationship (a "Dispute") will be resolved exclusively by final and binding arbitration. This includes disputes about the scope, validity or enforceability of this arbitration agreement, which the arbitrator will decide.

    Rules and forum. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect (adr.org), as modified by this section, before a single arbitrator. Unless you and Sarafand agree otherwise, it will be conducted by video, telephone or written submissions; if an in-person hearing is required, it will take place in the county where you live. Filing, administrative and arbitrator fees are governed by the AAA's rules. The arbitrator may award the same individual relief a court could, consistent with these Terms, including their limitations of liability. Judgment on the award may be entered in any court with jurisdiction.

    Class-action and jury-trial waiver. YOU AND SARAFAND EACH AGREE THAT DISPUTES WILL BE BROUGHT AND RESOLVED ONLY ON AN INDIVIDUAL BASIS, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, REPRESENTATIVE OR PRIVATE-ATTORNEY-GENERAL PROCEEDING, AND EACH OF US WAIVES THE RIGHT TO A JURY TRIAL. The arbitrator may not consolidate more than one person's claims or preside over any class or representative proceeding, and may award relief only to the individual party seeking it, and only as needed for that party's individual claim. This waiver does not apply to a claim for public injunctive relief, which is covered next.

    Public injunctive relief. A claim for public injunctive relief (relief whose main purpose and effect is to stop unlawful acts that threaten the general public) is not decided in arbitration. It must be brought in court under "Governing law," and it will be stayed until the arbitration of the individual claims, including any appeal, is complete. Nothing in these Terms waives a right to seek public injunctive relief that the law does not allow to be waived.

    Exceptions. Either party may (i) bring an individual claim in small-claims court if it qualifies and stays there, and (ii) seek injunctive or other equitable relief in court to protect its intellectual property or to stop unauthorized use of the App or our servers.

    Time limit. To the extent permitted by law, any Dispute must be started within one (1) year after the claim arose, or within the shortest period the law allows if that is longer, or it is permanently barred. The period is paused while the sixty (60) day informal resolution described above is under way.

    30-day right to opt out. You may opt out of this arbitration agreement by sending written notice to info@sarafandtech.com, or by post to the address in the Contact section, within thirty (30) days after you first accept these Terms. The notice must say that you opt out of arbitration and include your anonymous ID (shown in the App's Privacy Policy screen) or your name. Opting out does not affect any other part of these Terms.

    Severability. If the class-action waiver is found unenforceable for any claim, or a claim is found to seek public injunctive relief, that claim (and only that claim) must be severed and brought in court under "Governing law," and it will be stayed until the individual arbitration is complete. If any other part of this section is found unenforceable, the rest remains in effect.

    Changes. If we change this section after you accept these Terms, the change will not apply to any Dispute of which we had written notice before the change took effect.

    22. Apple App Store terms

    If you obtained the App from the Apple App Store, the following also applies. If it conflicts with the rest of these Terms, it controls as to your use of the App on Apple-branded products.

    Acknowledgement. These Terms are between you and Sarafand only, not Apple Inc. ("Apple"). Sarafand, not Apple, is solely responsible for the App and its content.

    Scope of license. Your license is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be used by other accounts associated with you through Family Sharing or volume purchasing.

    Maintenance and support. Sarafand is solely responsible for any maintenance and support of the App, to the extent required by these Terms or by law. Apple has no obligation whatsoever to provide maintenance or support for the App.

    Warranty. Sarafand is solely responsible for any product warranties, express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are Sarafand's responsibility, subject to the disclaimers and limitations in these Terms.

    Product claims. Sarafand, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including (i) product-liability claims, (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer-protection, privacy or similar legislation, subject to the disclaimers and limitations of liability in these Terms, to the extent permitted by law.

    Intellectual-property rights. If a third party claims that the App or your possession and use of it infringes that third party's intellectual-property rights, Sarafand, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of that claim.

    Legal compliance. You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo, or designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

    Developer contact. Direct questions, complaints or claims about the App to Sarafand at the contact information in the Contact section.

    Third-party terms. You must comply with applicable third-party terms of agreement when using the App.

    Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce them against you as a third-party beneficiary.

    23. Google Play terms

    If you obtained the App from Google Play, your purchase and use of the App are also subject to the Google Play Terms of Service and Google's payment and refund policies. Google is not a party to these Terms and is not responsible for the App.

    24. General terms

    Changes to these Terms. We may update these Terms. We will publish the updated Terms and change the date above, and give reasonable notice of material changes, for example in the App. Changes do not apply retroactively. Your continued use of the App after updated Terms take effect means you accept them, except as provided under "Changes" in the arbitration section.

    Export and location. The App is operated from the United States and is designed for U.S. roads. You are responsible for complying with local laws if you use it elsewhere, and with all applicable U.S. export-control and sanctions laws.

    Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Sarafand about the App and supersede all prior agreements and understandings on that subject.

    Severability. If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permissible, and the rest remains in full force and effect.

    No waiver. Our failure to enforce any right or provision is not a waiver of it.

    Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign them, in whole or in part, without restriction, including in a merger, acquisition, reorganization or sale of assets.

    Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control, including failures of networks, map data providers, app stores, hosting providers or utilities, natural disasters and acts of government.

    Relationship. Nothing in these Terms creates any partnership, joint venture, employment, agency or fiduciary relationship between you and Sarafand.

    Electronic communications. You consent to receive communications from us electronically, and agree that electronic notices satisfy any legal requirement that communications be in writing.

    Interpretation. Headings are for convenience only. "Including" means "including without limitation." If these Terms are translated, the English version controls.

    Rights that cannot be limited. Nothing in these Terms limits any right or liability that cannot be limited or excluded under the law that applies to you.
